General Terms of Sale
Legal document: the French version is authoritative.
1. Purpose
These General Terms of Sale (the "GTS") govern product purchases and subscription commitments offered on the Abyddos Shop, accessible at abyddos.com/boutique and on the studio's associated sites.
The service publisher is Abyddos — its full contact details are listed in the Legal notice.
Any purchase or subscription implies full and unconditional acceptance of these GTS.
2. Offers and prices
Abyddos offers several categories of products and services:
- SaaS subscriptions to the studio's products (Ma Brigade, SoftSCORE Pro, Atlas, and others) — monthly or annual
- Licences and early access to specific features
- Physical items in limited edition
Prices are shown in euros, all taxes included. Each offer's details are specified on its product page. Abyddos reserves the right to change its prices at any time, with reasonable prior notice given to current subscribers before any renewal at a new rate.
3. Subscription and payment
Payments are processed via Stripe, a PCI-DSS Level 1 certified provider. Credit card data is never stored by Abyddos.
Subscriptions automatically renew at each term (monthly or annual) until cancelled by the customer. In the event of a failed payment, service access is maintained until the end of the current period, then suspended until resolved. After 30 days without resolution, the account may be switched to read-only mode or deactivated.
4. Duration and cancellation
Subscriptions have no minimum commitment. The customer can cancel at any time from their personal space, or by sending a simple request to hello@abyddos.com.
Cancellation takes effect at the end of the current subscription period. No prorated refund is owed, unless required by law.
5. Right of withdrawal
In accordance with articles L.221-18 et seq. of the French Consumer Code, the consumer has a fourteen (14) day period to exercise their right of withdrawal, without having to justify their decision.
However, in accordance with article L.221-28 of the same Code, the right of withdrawal cannot be exercised for services whose performance has begun, with the consumer's express consent, before the end of the withdrawal period — which corresponds to the typical case of a subscription activated immediately upon signup.
6. Nature of the services
Abyddos services and products are provided "as is" according to the public descriptions on their respective pages. Abyddos endeavours to maintain their availability, security and accuracy, without however guaranteeing strictly uninterrupted operation (scheduled maintenance, third-party incidents, etc.).
Unless explicitly stated otherwise on the relevant product, Abyddos services do not constitute regulated professional advice, financial services, or a substitute for the opinion of a qualified professional.
7. Warranties and liability
Abyddos is subject to the legal warranties of conformity and hidden defects provided for in articles L.217-3 et seq. of the French Consumer Code, as well as articles 1641 et seq. of the French Civil Code.
Abyddos's liability cannot be engaged in the event of failure of a third-party service (host, payment provider, network operator, aggregator), except in cases of gross fault or serious negligence directly attributable to it.
8. Personal data
Data collected as part of the purchase or subscription is processed in accordance with our Politique de confidentialité, which itself complies with the General Data Protection Regulation (GDPR).
9. Applicable law and disputes
These GTS are governed by French law.
In the event of a dispute, amicable resolution will be sought as a priority. In accordance with article L.616-1 of the French Consumer Code, the consumer may also use consumer mediation free of charge, as well as the European online dispute resolution platform: ec.europa.eu/consumers/odr.
Failing amicable agreement, the French courts shall have sole jurisdiction.
